WAIVER OF COVID-19 LIABILITY, WAIVER OF LIABILITY, PHOTOGRAPHY RELEASE & VIDEOGRAPHY RELEASE

COMPLETING AND SUBMITTING THIS FORM IS AGREEING TO THIS COVID-19 WAIVER OF LIABILITY AND INDEMNIFICATION, WAIVER OF LIABILITY, PHOTOGRAPHY RELEASE & VIDEOGRAPHY RELEASE

1. I agree that I am personally responsible for my safety and actions while at DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks. I agree to comply with all DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks policies and rules, including but not limited to all DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks policies, guidelines, signage, and instructions. Because DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks is open to other individuals, I recognize that I am at higher risk of contracting COVID-19. With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks, DON-A-MATRIX TRAINING, LLC, its volunteers, participants, vendors, board members, officers, agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party attending DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks, or otherwise, while participating in any activity while in, on, or around DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks and/or while using any DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks facilities, tools, equipment, or materials.

2. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my participation in DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks and use of DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

3. By signing below I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in attending DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Don “DB DONAMATRIX” Brooks to decide whether to sign this document; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Waiver of Liability shall be governed by and construed in accordance with Virginia law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Waiver of Liability as a whole.

This waiver remains in effect until the State of Virginia lifts all COVID-19 related mandates.

COMPLETING AND SUBMITTING THIS FORM IS AGREEING TO THIS WAIVER OF LIABILITY AND PHOTOGRAPHY RELEASE

I am participating in physical activities, fitness classes, programs, workshops, and events offered by DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks during which I will receive information and suggestions about health, fitness and wellness.

I recognize that the activities I participate in at DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks may require physical exertion which may be strenuous and may cause aggravated physical injury, and I am fully aware of and willingly assume the risk and hazards involved. I understand that it is my sole responsibility to consult with a physician prior to my participation in any of the classes, programs, workshops, and events at DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks.

I represent and warrant that I am physically fit and have no medical condition which would prevent my full participation

in these activities. In consideration of being permitted to participate in any of the classes, programs,

workshops, and events at DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks , I agree to assume full responsibility for any risk, injuries, or damages, known or unknown, which I might incur as a result of participation in the activity.

I agree to inform my instructors of any physical limitations, discomfort and or injuries before or during fitness classes

and I take full responsibility for my own actions and my own limitations. In further consideration of being permitted to participate in any of the classes, programs, workshops, and events at DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks.

I knowingly, voluntarily and expressly waive, renounce and disclaim any claim I have or may have against DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks , its instructors, contractors, directors, partners, owners, and employees for loss, theft or damage of any personal property from the DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks premises, for injuries or damages that I may sustain within the DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks' grounds and/or facility, and/or for injuries or damages that I may sustain as a result of participating in the classes, programs, workshops, and events at DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks.

I forever release, waive, discharge, and covenant not to sue DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks for any injury or death caused by their negligence or other acts that are not intended to harm me.

I grant to DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks, its representatives and employees the right to take photographs and videos of me and my property in connection with the above-identified purposes.

I authorize DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks may use such photographs and videos of me with or without my name and for any lawful purpose, including but not limited to such purposes as publicity, illustration, advertising, and Web content.

I hereby waive the right to receive any payment for signing this release and waive the right to receive any payment for DONAMATRIX DAY: Our Hometown Fitness Festival Hosted by Celebrity Fitness Trainer Don "DB DONAMATRIX" Brooks use of any of the material described above for any of the purposes authorized by this release
